We know that your tour is very important to you and it is also extremely important to us, since we want you to enjoy it and to book again with us in the future. Please therefore spend a few minutes reading the following booking terms and conditions, as they form the basis of your contract with us.
These terms and conditions apply to all tours and events provided by Dark History Tours (“DHT”, “we,” “our”). By booking with DHT you are confirming that you have read and agreed the following terms and conditions:
All tours given are for historical and educational interest only. We do not advocate historical revisionism (particularly in regard to the Holocaust) or support or otherwise endorse political extremism of any type. Further, whilst some tours may focus on “Celtic”, Roman, Napoleonic or military themes, this should not be interpreted as supporting the politics, policies and events of these periods, political systems nor individuals cited.
Individuals who, in the course of a tour, attempt to use the locations visited or historical information given to further any racist or political belief (of whatever persuasion) shall be barred from further participation in the tour, without recompense. Dark History encourages historical debate and discussion but will not allow our services to be abused.
All visitors to Germany (whether or not they take a tour with Dark History) are reminded that denial of The Holocaust and the giving of the so-called “German Greeting” carry severe penalties here. Ignorance of this fact is not a defence.
All tours given are for historical and educational interest only!
German law is very clear on the use of politically charged symbols. However, the law – Strafgesetzbuch section §86a: also states –
“Subsection (1) shall not be applicable if the means of propaganda or the act serves to further civil enlightenment, to avert unconstitutional aims, to promote art or science, research or teaching, reporting about current historical events or similar purposes”
On our WW2 themed tours you be shown images and/or artefacts containing the Swastika symbol. Such images or items are purely for educational and pedagogical purposes only and in no way should be interpreted as endorsement for the policies of the NSDAP and associated agencies of the period nor with modern day extremist political parties. The same holds true with Soviet artefacts. While this should be patently obvious to even an amoeba, this is Germany!
Dark History shall not be held responsible for any loss or damage to property or individuals on any tour. Be aware that bicycle paths run along many pavements and also that in Europe, traffic drives on the right-hand side of the road. Whilst every care is taken on tours, we cannot be held responsible for accidents or incidents outside of our control. Ensure that you have adequate medical cover before you take your holiday.
We reserve the right to refuse or change the services offered on this website, verbally and on printed media, for any reason, at any time. When possible however, any changes or potential problems will be communicated as far in advance as is reasonably possible.
Persons who are, or appear to be, obviously intoxicated or otherwise under the influence of alcohol or drugs will be refused the offered services. On some tours a break is included. If alcohol is imbibed, please do so responsibly.
Duration of tours is subject to change due to variables such as weather conditions and the speed at which customers are walking. Therefore, all timings are approximate. If you are on a tight schedule then please tell your guide so that they can help you to make your deadline.
Please check the local weather conditions and dress accordingly. In the winter months suitably warm clothes are a must whilst a hat and gloves are strongly recommended. In the summer months Bavaria can be incredibly hot: protection from the sun is of paramount importance. A bottle of water is never a bad thing to have either.
To book your tour in the first instance send us an email from this site and tell us what you would like to do and the number of people in your group. Please mention whether anyone in the group has mobility, dietary or other issues since this may affect the tour route and timings. If possible, give us a firm date and time.
We will then return your email giving you a price for your group and confirmation that the date you have chosen is free.
To hold a date, a 50% deposit is required, to be paid at least 2 weeks before your tour. Requests for tours booked at shorter notice will be considered on a case by case basis and specific dates cannot be guaranteed. Payment of the deposit is preferred via Paypal or online banking, with the outstanding amount payable on the day of your tour in local currency.
As of April 2018 we will be trialling a new “Book Now” feature. This is suitable for credit card payments for “off-the-shelf” tours for up to four people. For larger groups and/or special requests, please email as above. We regret that credit bookings are the full amount upfront. Please note that fees apply for using this online booking feature.
Should you cancel more than one week in advance of your tour, you will receive the full deposit back, less any banking fees. Cancellation of tour within one week of start time: Dark History Tours retain your deposit unless in our opinion, there are especially mitigating circumstances.
Sometimes the unexpected really will happen. In the unlikely event that due to sickness/alien abduction/exile etc we are unable to provide your booked tour on the day and time specified, we will offer a similar or alternative tour exceeding the price you have already paid a deposit on, either with us or with another trusted company, or a full refund.
Insurance and personal responsibility
You must have your own personal travel insurance to cover you for flight delays, lost baggage, cancellations, medical problems, illness, accidents and unforeseen events. DHT shall not be responsible for any missed flights or other emergencies. DHT does not offer any travel insurance or cancellation insurance.
DHT shall not be held responsible or liable for any loss or damage (including, but not limited to, additional travel expenses, medical expenses and lost baggage) due to delay, cancellation or disruption of any kind caused by the laws, regulations, acts or failures to act, demands, orders or actions of any government, or by so called acts of God, environmental hazards, strikes, fire, flood, war, rebellion, terrorism, insurrection, personal sickness, accidents, quarantine, epidemics, theft or any other cause(s) beyond our control.
You waive and release any claim against DHT for any such loss, damage, injury or death, and by booking a tour you are confirming such waiver and release as a condition of participating in the tour.
Fitness and suitability for Dark History Tours
Our products can often involve a lot of walking for up to two miles in any one day, standing, negotiating stairs, visiting historic properties with uneven flooring and spiral staircases, getting on and off coaches, and other activities that require a good degree of mobility and a reasonable level of fitness. If you normally use a walking stick or wheelchair, you might find our tours challenging, but if we know in advance about any mobility problems, we will do our best to put in place special arrangements to help guests who might face difficulties. e.g at the Dachau Memorial, electric wheelchairs are available free of charge. If you are in any doubt about the suitability of any of our tours, or you are less able, it is essential that you consult with DHT before confirming your booking.
It is your responsibility to tell us before you book whether you have any special needs or medical conditions that might impact on your ability to take part on a DHT tour. We will assume, unless you tell us otherwise, that all members of the party are in a good state of health to participate in the tour. If you have doubts please let us know and the Tour Director will be in touch with you prior to booking to discuss the nature of the tour and your physical abilities.
If you do not tell us about any special needs or medical conditions, and we find ourselves in the position where you are unable to participate fully, then we reserve the right to organise extra assistance so that you can continue with the tour, and pass on the costs of doing this to you; or arrange your return home, and pass on the costs of doing this to you. We reserve the right to take action in the interests of your health and safety, and the health and safety of our staff and other customers, should we need to.
When you book with us, you accept responsibility for any damage or loss caused by you or any member of your party. Full payment for any such damage or loss must be paid direct at the time to the accommodation owner or manager or other supplier. If you fail to do so, you will be responsible for meeting any claims subsequently made against us (together with our own and the other party’s full legal costs) as a result of your actions.
DHT expect all clients to have consideration for other people. If in our reasonable opinion, or in the reasonable opinion of any other person in authority, you or any member of your party behaves in such a way as to cause or be likely to cause danger, upset or distress to any third party or damage to property, we are entitled, without prior notice, to terminate the tours of the person(s) concerned. We will have no further responsibility toward such participant(s) including any return travel arrangements. No refunds will be made and we will not pay any expenses or costs incurred as a result of the termination.
We reserve the right to decline any person as a participant in a DHT tour. We reserve the right to require a participant to withdraw from a tour at his or her own expense, at any time, when such action is determined by the tour staff to be in interests of the safety and welfare of other participants. (In reality, this is only likely on “Open” tours and not private bookings).
Parents with prams are requested to inform us during the booking process: just as with wheelchairs, they can have an impact on the route of the tour. We cannot guarantee that every site of interest will be equipped to handle prams. If this is likely, we will inform you and work towards a solution.
DHT shall not be held responsible for the conduct of young charges: parents are expected keep their youngsters under control. This is particularly important from a safety perspective in Germany where streets and pedestrianised zones frequently have cycle paths.
In the unlikely event that you feel dissatisfaction with any aspect of your holiday arrangements, we ask you to bring this to the attention of your guide at the time, so that the matter may be resolved right away. Until we know about a problem or complaint, we cannot begin to resolve it.
By entering into a booking with DHT you acknowledge that you have read the above and agree to the terms and conditions.
